60 DAY GUARANTEE
We are confident that you will love your new home—so confident, in fact, that we offer the Kisco Confidence® Satisfaction Guarantee. This program allows for a refund of your Community Fee and up to 60 days’ rent, subject to the terms and conditions outlined below.
Eligibility for the Confidence Satisfaction Guarantee
If you are not completely satisfied with your experience at [Insert Community Name], due to the Community’s failure to provide the services as outlined in your Residence and Services Agreement, Service Plan or Care Plan, you may be eligible to receive a refund of your Community Fee and up to 60 days’ rent—provided that all the following conditions are met:
- Minimum Residency and Move In Requirement : You must have physically moved into the Community—meaning you have transported your personal belongings into your assigned residence, taken physical possession of the unit, and begun living there on a daily basis— and lived at the Community in your apartment for at least sixty (60) consecutive days, but no more than ninety (90) days, from your official physical Move-In Date.
- Notice of Dissatisfaction:

- Written Notice: You must submit a written notice describing the services you are dissatisfied with and what specifically your dissatisfaction is to the Executive Director/General Manager within 5 calendar days of the occurrence or discovery of the issue that caused your dissatisfaction.
- Opportunity to Remedy: You must allow the Community a reasonable opportunity—5 calendar days from receipt of your notice—to correct or resolve the stated issue(s).
- Good Faith Cooperation: You must have reasonably cooperated with the Community’s efforts to deliver the agreed-upon services during your stay, including but not limited to participation in assessments, plan updates and allowing services to be rendered by the Community associates.
- Final Notice and Termination Form: If you remain dissatisfied, you must submit a final written notice using the form Exhibit A and deliver it to the Executive Director/General Manager no later than sixty-five (65) days after your Move-In Date listed above. Failure to do so will waive your right to claim the Kisco Confidence® Satisfaction Guarantee refund.
- Vacate Residence: You must vacate your residence and return all community property (e.g., keys, fobs) on or before 90 days from Move-In Date. Failure to vacate by this date will result in the waiver of your refund eligibility. You will remain responsible for all move-out costs.
- No Material Breach: You must not be in material breach of the Residence and Services Agreement at the time of your termination notice (e.g., non-payment of fees, damage to property, or misconduct).
- Refund: If all above conditions are satisfied, [Insert Community Name] will process a refund of your Community Fee and up to 60 days’ rent, less a cleaning and sanitation fee of $1,500, and any applicable costs for damage to your residence, if any (excluding normal wear and tear) within 30 days of your move out.
- Exclusions: The following items are excluded from the Kisco Confidence® Satisfaction Guarantee and are non-refundable:
- Monthly rent or fees for days you were in possession of the apartment in excess of 60 days from the move-in date.
- Charges related to care services, including level-of-care charges
- Any optional charges not included in the Monthly fee such as:
- Salon services
- Personal care items
- Extra housekeeping or laundry
- Parking or transportation
- Guest meals
- Alcohol purchases
- In-room meal service
In the event of a conflict between this Addendum and the terms of your Residence and Services Agreement, this Addendum shall control. Otherwise, the Residence and Services Agreement remains in full force and effect.
